These Terms and Conditions ("Terms") govern your access to and use of the Stays platform ("Stays," "we," "us," or "our"), operated by Greater Perks LLC. These Terms apply to all individuals who visit the Stays website, including without limitation "Visitors" (anyone accessing the Platform without an account) and "Users" (those who register an account, including both Hosts and Travelers).
By accessing or using the Platform in any capacity, you agree to these Terms. If you do not agree, you must not use the Platform.
1. Definitions
- Platform: The websites, apps, portals, and tools operated under Stays.co.
- Visitor: Anyone who accesses the Platform without registering an account.
- User: Any registered individual who has created an account and uses the Platform. All Users may access both Host and Traveler features.
- Host: A User who submits a Stay application and uses the Platform's hosting features to list a property.
- Traveler: A User who uses the Platform for Browse, discovery, and/or entering Giveaways.
- Stay: A vacation rental property listed on the Platform by a Host.
- Content: Any text, graphics, images, music, software, audio, video, information, or other materials generated, provided, or otherwise made available through the Platform, including User-Generated Content and Stays' own proprietary content.
- User-Generated Content: Any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Platform, including Stay listings, photos, and descriptions.
- Promotion: Paid advertising offered to Hosts to promote their Stay via third-party Instagram outlets.
- Outlet: A third-party Instagram account used to publish Promotions.
- Organization: A collaborative account structure for Users working together on a Stay or Promotion.
- Third Parties: External services integrated into the Platform, including PMS systems, Stripe, Airtable, Mailgun, and all social media Outlets.
2. Eligibility
The Platform is intended only for users 18 years or older. By using the Platform, you represent that you meet this requirement. Stays is available globally, but users are responsible for ensuring their use complies with local laws and regulations.
3. Account Registration and Access
You may use Stays as a Visitor without creating an account. However, to access features such as Stay submissions, Promotions, or Giveaways, you must register as a User.
All accounts have access to both Host and Traveler features; there are no separate "account types." You agree to:
- Provide accurate, current, and complete information during the registration process and keep your account information updated.
- Maintain the confidentiality and security of your login credentials.
- Accept full responsibility for all activities that occur under your account, whether or not you authorized such activities.
- Not use inappropriate, offensive, or infringing names for your account or profile.
Stays reserves the right to suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms, provide inaccurate information, or for any other reason, including account inactivity.
4. Hosting and Stay Listings
Users who wish to list a Stay must submit an application for approval. Stays reserves the right to accept or reject any application in its sole discretion.
Important disclaimers for Hosts:
- Responsibility for Listings: Hosts are solely responsible for the accuracy, completeness, and truthfulness of all information provided in their Stay listings, including descriptions, photos, amenities, pricing, and availability.
- No Verification by Stays: Stays does not verify Stay ownership, legal rights, permits, tax compliance, or the accuracy of any listing information.
- Compliance: Hosts are solely responsible for adhering to all local, state, and federal laws, regulations, and requirements, including but not limited to licensing, zoning, health and safety, tax obligations, and insurance requirements related to their properties.
- Property Maintenance & Safety: Hosts are responsible for ensuring their listed properties are safe, well-maintained, and comply with all applicable health and safety standards.
- External Bookings: All bookings, transactions, and communications related to a Stay must be handled externally between the Host and Traveler, outside of the Stays platform. Stays is not involved in these processes.
- Dispute Resolution: Stays is not responsible for resolving any disputes that may arise between Hosts and Travelers regarding bookings, property conditions, or any other matter.
5. Promotions and Giveaways
Approved Hosts may purchase Promotions to have content about their Stay posted to third-party Instagram Outlets.
Key policies for Promotions:
- Final Sales: All Promotions are final. No refunds or revisions will be issued unless Stays fails to publish the agreed Promotion altogether.
- Content Quality and Editorial Discretion: Promotions are subject to Stays' terms of content quality and editorial discretion. Stays reserves the right to reject or request revisions to Promotion content if it does not meet our standards or for any other reason at our sole discretion. Stays retains full control over what is published as part of a Promotion.
- No Guarantees: Stays offers no guarantee of performance, reach, engagement, or return on investment (ROI) on any Promotion.
- Outlet Changes: Stays reserves the right to change the specific Outlets used for Promotions at our discretion, for example, if an Outlet's quality declines or they violate agreements.
6. Payment Terms
All purchases on the Platform are processed via Stripe, a third-party payment processor. By submitting payment, you agree:
- To pay in full at checkout.
- That all Promotion sales are final unless a failure occurs on Stays' end as outlined in Section 5.
- That boosting, add-ons, and media selection are handled according to the Promotion design process.
- Refunds will only be issued if Stays is unable to fulfill a Promotion and/or Add-ons.
- Promotions may be canceled and refunded by Stays if Hosts provide low-quality or unusable media.
- In the event of a chargeback initiated by a User, Stays reserves the right to immediately suspend or terminate the associated account and pursue recovery of any disputed funds.
- Stays reserves the right to change pricing for Promotions or other services, with reasonable notice provided through the Platform or by email.
7. Platform Content and Intellectual Property
- User-Generated Content License: By uploading or submitting any User-Generated Content (including media, text, or other materials) to Stays, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly perform that Content for marketing, promotional, operational, or any other business purposes, across all media now known or hereafter devised.
- Content Warranties: You warrant that you own or have all necessary licenses, rights, consents, and permissions to use and authorize Stays to use all submitted media and Content, including media pulled from your social accounts or uploaded directly to Stays.
- Content Removal: Stays reserves the right to remove any User-Generated Content that violates these Terms, is deemed inappropriate, or for any other reason at Stays' sole discretion, without prior notice.
- Feedback: If you provide any feedback, comments, or suggestions to Stays ("Feedback"), you grant Stays an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve the Platform or our services, without any obligation or compensation to you.
- Stays' Intellectual Property: All Content on the Platform, including but not limited to text, graphics, logos, images, software, and the compilation thereof, other than User-Generated Content, is the property of Greater Perks LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use any of Stays' intellectual property without our express written permission.
8. Third-Party Tools and Liability
The Platform utilizes several third-party services, including but not limited to:
- Stripe (payment processor)
- Mailgun (email delivery)
- PMS providers (property management systems Hosts may link to their Stay listings)
- Instagram (where Promotions are published)
Stays is not responsible for errors, data breaches, outages, or losses arising from third-party tools or integrations. Users acknowledge and agree that they are solely responsible for their interactions with these third-party tools and platforms. Outlets are independently operated. Stays assumes no liability for Outlet performance, content changes, follower counts, or content delivery errors.
9. Marketplace Limitations
Stays is not a booking platform. We do not process bookings or transactions. All bookings must be handled externally, including those made via linked PMS platforms.
Stays does not own or operate any Stay and is not affiliated with Hosts or their properties. We are not responsible for:
- The accuracy of Stay listings.
- Bookings made off-platform.
- Traveler satisfaction.
- Damages, injuries, or fraudulent listings.
- Communications between Users on or off the Platform; any such communications are solely the responsibility of the Users involved.
Use the Platform at your own risk. Stays does not endorse any specific Host, Stay, or Traveler, and any references on the Platform do not constitute an endorsement. You acknowledge that you rely on information on the Platform at your own risk.
10. User Conduct and Security
You agree not to:
- Misrepresent yourself or your Stay.
- Share login credentials with unauthorized individuals.
- Grant access to individuals who should not have it.
- Misuse your Organization role or dashboard access.
- Interfere with the Platform, bypass security measures, or use automation (e.g., bots, scrapers) to access or interact with the Platform without express written permission from Stays.
- Engage in any illegal activities or promote illegal activities through the Platform.
- Transmit or distribute spam, unsolicited commercial messages, or chain letters.
- Harass, stalk, defame, abuse, or otherwise violate the legal rights of others.
- Post or transmit any content that is discriminatory, hateful, obscene, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Upload or transmit files that contain viruses, malware, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
You are solely responsible for managing user permissions within your Organization. Stays is not liable for damages caused by misuse or unauthorized access by any user with access to your Organization.
If you become aware of any conduct that violates these Terms, please report it immediately to admin@stays.co.
11. Copyright and DMCA

We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown requests promptly.
12. Disclaimers and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- "AS IS" Basis: Stays is provided "AS IS" and "AS AVAILABLE" with no warranties or guarantees of any kind, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- No Guarantees: We do not guarantee platform uptime, availability, security, accuracy, or that the Platform will be error-free or uninterrupted.
- Limitation of Liability: Stays, Greater Perks LLC, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage, arising from your use of the Platform or any Content (including Promotions or Stays discovered via the Platform), even if Stays has been advised of the possibility of such damages.
- No Liability for External Factors: Stays is not liable for any issues related to User-Generated Content, third-party platforms, listed properties, or third-party Outlets.
- Indemnification: You agree to indemnify, defend, and hold harmless Stays, Greater Perks LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
- Your access to or use of the Platform.
- Your violation of these Terms.
- Your User-Generated Content.
- Your interaction with any Host, Traveler, or other User.
- Your participation in any Promotion or Organization.
- Your violation of any law or the rights of a third party.
13. Arbitration, Class Waiver, and Governing Law
All disputes arising out of or relating to these Terms or your use of the Platform shall be resolved exclusively via binding arbitration in the state of Michigan, in accordance with the rules of the American Arbitration Association. The arbitration will be conducted by a single arbitrator.
By agreeing to these Terms, you waive:
- Any right to a jury trial.
- Any right to participate in a class action or class-wide arbitration.
Notwithstanding the foregoing, either party may bring an individual action in small claims court if the dispute qualifies for such court.
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws principles.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We may provide notice of changes via the Platform, email, or other reasonable means. The revised Terms will be effective as of the "Last Updated" date indicated at the top of these Terms. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
